Unexpected Vacancies on the Board

Situations may arise when a board member resigns before his or her term of office is up or a director may suddenly become disqualified under the Condominium Act, 1998, to serve as a director on the board.  Who is responsible to fill the sudden vacancy?

As a board member or manager, you may find yourself in unexpected situations like these and you should not make any decisions on behalf of the condominium corporation once it is determined that quorum of the board has been lost due to such vacancy/vacancies.  If your condominium corporation finds itself in this dilemma, contact our office and chat with one of Fine & Deo’s condominium lawyers for further information.
